REGLEMENT D’UNE OPERATION 

DE LOTERIE PUBLICITAIRE

 

1. Société organisatrice

La société WAAA (ci-après la « société organisatrice »), société par actions simplifiée unipersonnelle, au capital social de 1.000€, dont le siège social est sis 1 RUE DU 11 NOVEMBRE 1918, VILLIERS-SUR-MARNE (94350), immatriculée au RCS de CRETEIL sous le numéro 848676532, organise une opération de loterie publicitaire.

L’opération commerciale est intitulée « Firenze » ou l’Opération, et est accessible directement sur l’application WAAA.

2. Modalités de participation

La participation à l’Opération est gratuite et sans obligation d’achat. Elle est ouverte à toute personne physique, majeure, ayant leur pleine capacité juridique et disposant d’un compte WAAA Premium, disposant d’une adresse électronique valable, à l’exclusion des employés des sociétés ayant collaboré à son organisation et/ou à sa promotion ainsi qu’aux membres de leur famille (conjoints, ascendants, descendants, frères et sœurs), ainsi que toute personne ayant participé à l’élaboration de l’Opération.

La participation à l’Opération est limitée à une seule participation par personne physique (rattachée à une adresse IP, un nom, un prénom et une adresse email). Seule la première participation sera prise en compte en fonction de son adresse IP enregistrée. 

La participation à l’Opération implique l’acceptation pleine et entière du règlement et de son application par les participants, sans aucune réserve.

Tout participant ayant communiqué à la Société Organisatrice des coordonnées fausses ou erronées, sera exclu de l'Opération.

Tout contrevenant à l’un ou plusieurs des articles du présent règlement sera privé de la possibilité de participer, mais également du Lot qu’il aura pu éventuellement gagner. Il en est de même en cas de fraude, usurpation d’identité ou tentative de tricherie.

 

3. Modalités de l’Opération

La durée de l’Opération s’étend du 1er avril 2025 au 12 janvier 2026 minuit (heure française).

Pour participer, il suffit pour les participants de choisir le lot mis en jeu et de cliquer sur « Participer ».

L’affectation des Lots, par tirage au sort, se déroulera le 12 janvier 2026. À cette occasion, il sera tiré au sort également 4 participants supplémentaires, qui seront pris en considération en cas de refus ou renonciation par les gagnants du premier tirage. Il est entendu que l'ordre de désignation des gagnants sur liste d'attente suivra l'ordre chronologique du tirage au sort des bons de participations.

 

4. Lot pour l’Opération

 

La Société organisatrice met en jeu :

  • Un voyage à destination de Florence du 12/03/2026 au 15/03/2026

 

Le voyage inclut le transport (avion, train ou bus), l’hôtel, les déjeuners et diners, et des activités limitativement énumérées pour 4 personnes, sous réserve de disponibilités [Galerie des Offices + Académie, la cathédrale et son dôme].

Valeur unitaire : 1 500 €.

 

Le Lot ne comprend pas les autres dépenses et frais de déplacement non expressément mentionnés. Sont notamment exclus : l’acheminement du domicile des Gagnants vers l’aéroport ou la gare, les frais de stationnements de leur véhicule, le transfert entre l’aéroport/la gare vers l’hôtel, les consommations dans le minibar de la chambre.

 

Le Lot est nominatif. Il n’est pas remboursable, ni modifiable, ni échangeable, ni cessible, ni transférable à un tiers. 

 

5.Modalités de remise du Lot

Le Lot sera remis au Gagnant dans un délai de 30 jours à compter de la date du tirage au sort, par email à l’adresse communiquée par celui-ci lors de sa participation à l’Opération. Il appartiendra au Gagnant de vérifier si l’email reçu n’a pas été placé dans ses courriers indésirables.

Pour bénéficier du Lot, le Gagnant devra fournir à la Société organisatrice, à sa demande, toute pièce justificative de son identité (carte d’identité / passeport) et de son adresse.

Si un gagnant ne se manifeste pas dans les 10 jours ouvrés à compter de la date d’envoi de l’email l’informant de son gain, il sera considéré comme ayant renoncé à son Lot et le Lot sera réattribué au suivant sur la liste d’attente.

Aucun message ne sera adressé aux perdants.

 

6. Publicité relative à l’Opération

Le Gagnant accepte que son identité (nom et prénom) soit publiée par la Société organisatrice sur tout support média, dont réseaux sociaux, sans pouvoir exiger une quelconque contrepartie, droit ou rémunération, autre que l’attribution de son Lot.

 

7. Changement / indisponibilité /actualisation des Lots/modification de l’Opération

La Société organisatrice se réserve le droit, si les circonstances l’exigent, de modifier, compléter, proroger, suspendre, annuler ou reporter tout ou partie de l’Opération, sans préavis, sans qu’aucun dédommagement ne puisse être réclamé, ou que sa responsabilité ne puisse être engagée de ce fait. Les modifications des conditions de l’Opérations seront publiées sur l’application et le site.

Les Lots sont offerts sous réserve de disponibilité des prestataires. La Société Organisatrice se réserve le droit, si des circonstances indépendantes de sa volonté l'exigeaient ou, plus généralement, pour quelque raison que ce soit, de modifier la dotation en tout ou partie, et/ou de la remplacer par un Lot de nature et de valeur au moins équivalente, sans que sa responsabilité ne puisse être engagée à ce titre.

La Société organisatrice ne pourra pas être tenue pour responsable en cas de modification/retard/suppression des vols/trains/bus.

 

8. Frais de participation

Les frais postaux nécessaires à l’envoi du formulaire de participation à l’Opération par courrier seront remboursés sur demande écrite à la Société organisatrice, accompagné d’un justificatif de frais engagés et d’un RIB.

Les frais de connexion au site pour participer à l’Opération seront également remboursés sur justificatif. Néanmoins, il est rappelé que si l'abonnement aux services du fournisseur d'accès est contracté par l'internaute pour son usage de l'Internet en général et dans la mesure où le fait pour le participant de se connecter au site et de participer à l’Opération ne lui occasionne aucun frais ou débours supplémentaire, la connexion au site ne pourra donner lieu à aucun remboursement.

 

9. Données à caractère personnel

Les données à caractère personnel recueillies pourront faire l'objet d'un traitement informatisé dont la finalité est de sélectionner et annoncer les gagnants par la voie du tirage au sort, et de les informer du résultat de l’Opération.

Les données à caractère personnel recueillies pourront également être utilisées pour l'envoi de newsletters aux participants ayant donné leur accord en cochant la case y afférent.

Les données à caractère personnel transmises par les participants sont destinées à la Société Organisatrice, responsable du traitement. Néanmoins, elles pourront également être transmises aux partenaires de la Société Organisatrice à des fins de prospection commerciale si le participant a donné son accord en cochant la case y afférent.

Les données à caractère personnel des Gagnants seront transmises aux prestataires (compagnie aérienne, train, bus, hôtel) pour la remise des Lots nominatifs.

Le traitement des données s'effectue dans les conditions explicitées au sein des CGV/CGU de l’application, que chaque participant est invité à consulter et accepter au moment de son inscription. Le participant pourra notamment prendre connaissance de tous les droits dont il dispose. 

 

10 .Droit applicable et contestations

Le présent règlement est soumis au droit français.

Pour être prises en compte, les éventuelles contestations relatives au présent règlement devront être formulées sur demande écrite à la Société organisatrice au plus tard 15 jours après la date du tirage au sort contesté.

Toute difficulté pratique d’application ou d’interprétation sera tranchée par la Société organisatrice.

LOTTERY OPERATION

 

1. Organizing Company

The company WAAA (hereinafter referred to as the "Organizing Company"), a simplified joint-stock company with a capital of €1,000, whose registered office is located at 1 RUE DU 11 NOVEMBRE 1918, VILLIERS-SUR-MARNE (94350), registered with the RCS of CRETEIL under number 848676532, is organizing a promotional lottery operation.
The commercial operation is titled “Firenze” or the "Operation" and is directly accessible via the WAAA application.

2. Participation Terms

Participation in the Operation is free and without any purchase obligation. It is open to any natural person of legal age, with full legal capacity, holding a WAAA Premium account, and possessing a valid email address. Employees of companies involved in the organization and/or promotion of the Operation, as well as their family members (spouses, ascendants, descendants, siblings), and anyone who participated in the development of the Operation, are excluded from participation.
Participation in the Operation is limited to one entry per person (linked to an IP address, name, first name, and email address). Only the first participation will be considered based on the registered IP address.
Participation in the Operation implies full and unconditional acceptance of these rules and their application by the participants.
Any participant who provides false or incorrect contact details to the Organizing Company will be excluded from the Operation.
Anyone violating one or more of the provisions of these rules will be disqualified from participating and from receiving any potential prize won. The same applies in cases of fraud, identity theft, or cheating attempts.

 

3. Operation Details

The Operation runs from April 1, 2025 to January 12, 2026, at midnight (French time).
To participate, entrants simply need to select the prize available and click "Participate."
The prize allocation, determined by a random draw, will take place on January 12, 2026. On this occasion, four additional participants will also be drawn as backups in case the initial winners decline or renounce their prizes. The order of the backup winners will follow the chronological order of the draw.

 

4. Prize of the Operation

The Organizing Company is offering:

  • A trip to Florence from March 12, 2026, to March 15, 2026.

The trip includes transportation (plane, train, or bus), hotel accommodation, lunches and dinners, and a limited number of activities for four people, subject to availability [Uffizi Gallery + Accademia, the cathedral, and its dome].
Unit value: €1,500.

The Prize does not include additional expenses or travel costs not explicitly mentioned. Specifically excluded are:

  • Transport from the winners' home to the airport or train station.
  • Parking fees for their vehicle.
  • Transfers between the airport/train station and the hotel.
  • Minibar consumption in the hotel room.

The Prize is nominative. It is non-refundable, non-modifiable, non-exchangeable, non-transferable, and cannot be assigned to a third party.

 

5. Prize Delivery Terms

The Prize will be awarded to the Winner within 30 days from the date of the draw via email, sent to the address provided at the time of participation. It is the Winner's responsibility to check whether the email has been placed in their spam folder.
To claim the Prize, the Winner must provide the Organizing Company with any necessary proof of identity (ID card/passport) and address upon request.
If a Winner does not respond within 10 business days of the email notification of their win, they will be deemed to have forfeited their Prize, and it will be awarded to the next participant on the backup list.
No notifications will be sent to non-winning participants.

 

6. Publicity Related to the Operation

The Winner agrees to have their identity (name and surname) published by the Organizing Company on any media platform, including social networks, without demanding any compensation, rights, or remuneration beyond the awarding of their Prize.

 

7. Changes / Unavailability / Prize Updates / Operation Modification

The Organizing Company reserves the right, if circumstances require, to modify, extend, suspend, cancel, or postpone all or part of the Operation without prior notice, without any compensation being claimed, and without its liability being engaged. Any changes to the Operation’s conditions will be published on the application and website.
Prizes are subject to service provider availability. The Organizing Company reserves the right, if circumstances beyond its control necessitate it or for any other reason, to modify the prize, in whole or in part, and/or replace it with a prize of at least equivalent nature and value, without liability.
The Organizing Company shall not be held responsible for any modifications, delays, or cancellations of flights, trains, or buses.

 

8. Participation Costs

Postal costs necessary for submitting a participation form via mail will be reimbursed upon written request to the Organizing Company, accompanied by proof of expenses incurred and a bank account statement (RIB).
Internet connection costs for participation will also be reimbursed upon proof of expense. However, it is reminded that if the participant has a general internet service subscription and their participation in the Operation does not incur additional costs, no refund will be issued.

 

9. Personal Data

The personal data collected may be subject to computerized processing for the purpose of selecting and announcing the winners by random draw and informing them of the Operation's outcome.
Collected personal data may also be used for sending newsletters to participants who have given their consent by ticking the relevant box.
Personal data provided by participants is intended for the Organizing Company, which is responsible for data processing. However, it may also be shared with the Organizing Company’s partners for marketing purposes if the participant has consented by ticking the relevant box.
Winners’ personal data will be transmitted to service providers (airline, train, bus, hotel) for the delivery of the nominative prizes.
The processing of data is carried out under the conditions detailed in the application's Terms and Conditions (CGV/CGU), which each participant is invited to review and accept upon registration. Participants may also review their data protection rights.

 

10. Applicable Law and Disputes

These rules are governed by French law.
Any disputes regarding these rules must be submitted in writing to the Organizing Company no later than 15 days after the date of the contested draw.

The Prize is nominative. It is non-refundable, non-modifiable, non-exchangeable, non-transferable, and cannot be assigned to a third party.

 

5. Prize Delivery Terms

The Prize will be awarded to the Winner within 30 days from the date of the draw via email, sent to the address provided at the time of participation. It is the Winner's responsibility to check whether the email has been placed in their spam folder.
To claim the Prize, the Winner must provide the Organizing Company with any necessary proof of identity (ID card/passport) and address upon request.
If a Winner does not respond within 10 business days of the email notification of their win, they will be deemed to have forfeited their Prize, and it will be awarded to the next participant on the backup list.
No notifications will be sent to non-winning participants.

 

6. Publicity Related to the Operation

The Winner agrees to have their identity (name and surname) published by the Organizing Company on any media platform, including social networks, without demanding any compensation, rights, or remuneration beyond the awarding of their Prize.

 

7. Changes / Unavailability / Prize Updates / Operation Modification

The Organizing Company reserves the right, if circumstances require, to modify, extend, suspend, cancel, or postpone all or part of the Operation without prior notice, without any compensation being claimed, and without its liability being engaged. Any changes to the Operation’s conditions will be published on the application and website.
Prizes are subject to service provider availability. The Organizing Company reserves the right, if circumstances beyond its control necessitate it or for any other reason, to modify the prize, in whole or in part, and/or replace it with a prize of at least equivalent nature and value, without liability.
The Organizing Company shall not be held responsible for any modifications, delays, or cancellations of flights, trains, or buses.

 

8. Participation Costs

Postal costs necessary for submitting a participation form via mail will be reimbursed upon written request to the Organizing Company, accompanied by proof of expenses incurred and a bank account statement (RIB).
Internet connection costs for participation will also be reimbursed upon proof of expense. However, it is reminded that if the participant has a general internet service subscription and their participation in the Operation does not incur additional costs, no refund will be issued.

 

9. Personal Data

The personal data collected may be subject to computerized processing for the purpose of selecting and announcing the winners by random draw and informing them of the Operation's outcome.
Collected personal data may also be used for sending newsletters to participants who have given their consent by ticking the relevant box.
Personal data provided by participants is intended for the Organizing Company, which is responsible for data processing. However, it may also be shared with the Organizing Company’s partners for marketing purposes if the participant has consented by ticking the relevant box.
Winners’ personal data will be transmitted to service providers (airline, train, bus, hotel) for the delivery of the nominative prizes.
The processing of data is carried out under the conditions detailed in the application's Terms and Conditions (CGV/CGU), which each participant is invited to review and accept upon registration. Participants may also review their data protection rights.

 

10. Applicable Law and Disputes

These rules are governed by French law.
Any disputes regarding these rules must be submitted in writing to the Organizing Company no later than 15 days after the date of the contested draw.
Any practical difficulties in applying or interpreting these rules will be resolved by the Organizing Company.
